There are several aspects that need to be considered in order for flood management requirements to be met. The requirements depend on several factors, including the flood zone on your land. The main compliance requirement is that the lower floor, as defined in the rules/codes, must be increased above or above the OFEN. Our rules define these conditions: significant damage means damage to any cause suffered by a structure in which the cost of rehabilitating the structure on its condition before the damaged state is or would exceed 50 percent of the market value of the structure before the appearance of the damage. Significant improvement means any reconstruction, remediation, addition or other improvement of a structure that is or exceeds 50 per cent of the market value of the structure before construction begins. These are structures that have suffered “significant damage” regardless of the repair work actually carried out. However, the term is also not included: the City of Hempstead`s flood management regulations and codes, as requested by the Federal Emergency Management Agency, stipulate that all new buildings to be built in special flood zones (regulated flood zones) must reach or exceed their deepest floors above or above the base flood height (BFE). The regulations also provide that substantial improvements to existing buildings (transformation, renovation, renovation or complement) or buildings that have suffered significant damage must meet the requirements for new construction.
